Terms of Service

When you subscribe to Atlantic Internet Technologies, Inc. (AIT’s) Exit 109 Internet Service, you agree to abide by the terms and conditons as set forth and displayed on our home pages at www.exit109.com. These terms contain the rules listed below. Violation of these rules may result in the termination of your AIT account. AIT reserves the right to change these terms at any time.

  1. The Subscriber warrants to Atlantic Internet Technologies, Inc. (AIT) that he/she is at least eighteen years old. If the Subscriber is a minor, the parent or legal guardian hereby consents to the use of AIT’s services by the minor. The parent or guardian further agrees to be responsible for the use of AIT’s services by the minor in accordance with the terms and conditions herein, and to be responsible for all charges for service incurred by such minor. The parent or guardian understands that some material available through the services of AIT and other connected Internet hosts may not be appropriate for persons under the age of 18 (eighteen).

  2. The Subscriber agrees to use the services provided by AIT for lawful purposes only, and further stipulates that Subscribers use of AIT facilities and the information stored, transmitted or received by the Subscriber utilizing AIT’s facilities is not in violation of any United States Federal or state statutes or regulations, including but not limited to export control, obscenity, copyright, trade secret, harassment or other statutes. Subscriber also understands and agrees that since AIT exercises no control whatsoever over the content of the information that is stored or transmitted over its facilities, that the full burden of compliance with all applicable laws and statutes rests upon the Subscriber. Subscriber agrees to indemnify and hold AIT harmless from any damages arising from Subscriber’s use of AIT services and facilities.

  3. The following activities are prohibited. AIT reserves the right to suspend or terminate accounts for engaging in these activities:

a) Illegal activities, or any activity that is adverse to the interests of AIT.

b) Sharing Subscriber’s password with any third party, or allowing another individual to use an individual account, except in the immediate presence of the Subscriber.

c) Use of web page display space in a personal account for commercial purposes.

d) Tampering with other accounts, or committing unauthorized intrusion into any part of AIT’s system or using any AIT machine, files or accounts to gain unauthorized access into any other system.

e) Using AIT services not included in your subscription or devising ways to circumvent security and/or accounting for the purpose of receiving services without payment (theft of services).

f) Use of AIT’s services either willfully or negligently in a manner that encumbers system resources, including but not limited to disk space, processors, memory or other system resources so as to interfere with the normal use of AIT’s services by other subscribers. This is commonly referred to as a “denial of services” attack.

g) Using AIT’s system or resources to carry out a denial of service attack on another system or individual.

h) Harassing users on AIT’s facilities or elsewhere by sending e-mail or messages to a person or entity who has explicitly and unambiguously requested that this activity cease.

i) Sending unsolicited commercial email, or unsolicited bulk email.

j) Sending bulk email or newsgroup/forum/comment spam from another site, using an address on AIT’s system as a contact or “maildrop” address.

k) Sending bulk email or newsgroup/forum/comment spam from another site, advertising or promoting a web site or other service provided through AIT’s system.

l) Sending chain letters or messages which offer a product or service based on the structure of a chain letter.

m) Sending electronic mail that is purposely designed to interfere with the operation of software and hardware responsible for electronic mail transport and reception.

n) Repeatedly violating the currently acceptable norms of behavior on the Internet (violations of Netiquette.)

o) Forging email messages so they appear to have come from another person, business, or other entity.

  1. Access to other networks is governed by the rules of those networks, where those rules are more strict than ours. Violation of the rules of other networks is considered a violation of these terms.

  2. In all matters of improper use of AIT’s service by a Subscriber, decisions by AIT are final. Accounts terminated for violations of these terms of service will not be eligible for refunds of any fees already paid for the account.

  3. AIT makes no warranties whatsoever for the service it provides to its Subscribers, including any warranty of merchantability, or suitability for a particular purpose. AIT further disclaims any responsibility for the privacy or integrity of any information that is stored upon or transmitted to or from AIT’s facilities, including, but not limited to the loss of data arising from interruption of service, delays, or other events which may cause loss or corruption of information. Further, AIT disclaims any responsibility for the accuracy or completeness of any information provided to the Subscriber from any source within AIT, or from its connected networks.

  4. Charges for all individual accounts must be paid in advance. Any accounts that are delinquent on the expiration date of the account may be terminated by AIT. AIT will inform Subscribers of the expiration date of their account via electronic mail. AIT may charge a Subscriber a fee for restoring a deactivated account. Currently, this fee is $15.00. Returned checks will be subjected to a $25.00 charge. Delinquent accounts will be charged interest at the rate of 1.5% per month. Subscriber accepts responsibility for the reasonable costs of collection, including AIT’s legal fees.

  5. If you wish to cancel your account, you must provide at least three (3) business days notice prior to your account renewal date, or you may be charged for an additional month.

  6. AIT reserves the right to change its rates upon 30 days notice to all subscribers. Notice shall be in the form of electronic mail to the subscriber’s account, and by posting to the home pages of Exit 109 at https://exit109.com.

Reports of abuse by our customers can be sent to [email protected]. Please include full headers of mail or Usenet posts, to ensure we can track down the offender and deal with the situation.
